Return and Refund Policy

At LIEM ART we work to ensure that each work reaches its destination in the best conditions. All pieces are carefully checked before shipment and are packed using appropriate materials and protection systems to ensure their safety during transport.

Our goal is to provide a satisfactory and transparent shopping experience. Returns, the exercise of the right of withdrawal, refunds and incidents related to orders will be handled in accordance with the applicable regulations and the conditions indicated below.

1. Right of withdrawal

In purchases made at a distance, when the customer has the status of consumer, he may exercise, in general, his right of withdrawal within the period of 14 calendar days from receipt of the work or product, without having to state the reason and without assuming other costs other than those provided for by law.

The exercise of the right of withdrawal must be communicated to LIEM ART by means of an unequivocal declaration within the corresponding period. The client may do so by sending an email to contact@liem-art.comIt will not be necessary to use a specific form, although the legally provided model withdrawal form may be used.

Once the notice of withdrawal has been received, LIEM ART will inform the client of the procedure necessary to return the work.

2. Exceptions to the right of withdrawal

The right of withdrawal will not be applicable in those cases in which any of the exceptions provided for by current regulations are met.

In particular, works that have been Made to customer specifications or clearly customized, under the terms established by law.

The consideration of a work as a unique or original piece does not in itself imply the exclusion of the right of withdrawal. The applicable conditions will be determined taking into account the specific characteristics of the work and the operation carried out.

3. Conditions for return

Where the right of withdrawal becomes applicable, the client must return the work without undue delay and, in any case, no later than within the deadline of 14 calendar days from the date you communicate your decision to withdrawThis period will be considered fulfilled if the refund is made before the end of this period.

The client must handle and preserve the work with the necessary diligence. It may be liable for the decrease in value of the work that results from a handling other than that necessary to establish its nature, characteristics or operation, in accordance with the applicable regulations.

• Whenever possible, it is recommended to keep the original packaging or the packaging used for delivery, especially in large-format works, in order to ensure adequate protection during return transport.
• When LIEM ART provides specific instructions for the protection of a work during its return, it is recommended to follow them to reduce the risk of damage during transport.
• Whenever possible, it is recommended to also keep the documentation that accompanied the work.
• If the return is caused by damage during transport, lack of conformity or any other incident other than the withdrawal, the customer must indicate this when contacting LIEM ART.

The preservation and use of the original packaging does not in itself constitute a condition for exercising the right of withdrawal.

4. Return costs

When the right of withdrawal becomes applicable, the client will assume the Direct costs of returning the work, unless LIEM ART has expressly agreed to assume them or has not been previously informed of this obligation, in accordance with current regulations.

LIEM ART will be able to manage and coordinate the return transport through a transport service appropriate to the characteristics of the work and its destination. In these cases, the customer will be informed in advance of the corresponding cost before organising the collection.

The customer may, if he so prefers, directly organise the return transport, after notifying LIEM ART. In this case, he must use a transport service appropriate to the characteristics, dimensions and value of the work and guarantee sufficient protection during transport.

In large-format works, due to their dimensions and characteristics, return transport may require specialized services and have a considerably higher cost than an ordinary shipment.

The fact that the initial shipment of a work has been included in the purchase price does not imply that the transport of any return is free of charge when it occurs as a result of the exercise of the right of withdrawal.

5. Refunds

Where a refund is due as a result of the exercise of the right of withdrawal, LIEM ART will refund to the customer all payments received in connection with the purchase, including, where applicable, the Ordinary delivery costs paid by the customer.

When the customer has expressly chosen a delivery method other than the less expensive ordinary method offered by LIEM ART, it will not be necessary to reimburse the additional costs derived from such a choice, under the terms established by law.

The refund will be made without undue delay and, in any case, within the maximum period established by law from the date on which LIEM ART has been informed of the withdrawal decision.

The refund will be made using, whenever possible, the same means of payment used by the customer for the purchase, unless the customer has expressly provided otherwise and provided that he does not incur any expenses as a result of the refund.

In sales contracts, LIEM ART may withhold the refund until the returned work has been received or until the customer presents proof of the return, depending on which condition is met first, in accordance with current regulations.

The refund corresponding to the withdrawal will not include the direct costs of return that correspond to the customer as indicated in this policy.

6. Incidents during transport and lack of conformity

If the work arrives with apparent damage caused during transport, the client must contact LIEM ART as soon as possible, providing clear photographs of both the work and the packaging received.

When possible, it is recommended to record the visible damage at the time of delivery. This information will facilitate the management of the incident and allow the corresponding measures to be assessed.

When a work presents damages, defects or any other lack of conformity that is the responsibility of LIEM ART, the incident will be managed in accordance with the applicable regulations and the client will not assume the costs that legally correspond to the seller.

Returns arising from a lack of conformity or an incident of transport will not be considered, for these purposes, as a return due to simple withdrawal.

7. Communication and return procedure

1. Contact LIEM ART indicating the order number and specifying whether it is an exercise of the right of withdrawal, a transport incident, a lack of conformity or any other circumstance.
2. In case of damage during transport, please attach clear photographs of the work and the packaging received.
3. In the event of withdrawal, LIEM ART will indicate the return procedure and, where applicable, the direct cost of the return transport before organising the pick-up.
4. When LIEM ART manages the return transport, we will coordinate with the client the collection through a transport service appropriate to the characteristics of the work.
5. If the client prefers to manage the transport directly, he must notify LIEM ART in advance and use a service appropriate to the characteristics, dimensions and value of the work.
6. Where possible, it is recommended to use the original packaging or equivalent protection system to minimize the risk of damage during return transport.

Our goal is to manage each request as quickly as possible, offering personalized attention and maintaining clear communication throughout the process.

8. Original works and custom commissions

LIEM ART mainly creates original works, conceived as unique pieces. Original works available for purchase directly in the store and orders placed specifically in accordance with the customer's instructions may be subject to different conditions in terms of withdrawal, depending on their characteristics and the applicable regulations.

The purchase of an original work that is already finished and available for purchase does not in itself imply that it is excluded from the right of withdrawal.

In the case of custom orders, LIEM ART will inform the customer of the applicable conditions before starting the work.
